Abstract
These Rules are enacted for recognizing and vesting the forest rights and occupation in forest land in forest dwelling scheduled tribes and other traditional forest dwellers residing in such forests.
According the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007), the Gram Sabha shall be the authority empowered to initiate the process of determining the nature and extent of forest rights that may be given to forest dwelling Scheduled Tribes and other traditional forest dwellers. The Rules provides for the functions of the Gram Sabha, including: (a) Initiate the process of determining the nature and extent of Forest Rights, receive and hear the claims relating thereto; (b) prepare a list of claimants of forest rights and maintain a register; (c) Pass a resolution an claims on forest rights after giving reasonable opportunity to interested persons and authorities concerned and forward the same to the SubDivisional Level Committee; (d) Constitute Committee for the protection of wildlife, forest an biodiversity. The Rules further make provisions for: functions of the sub-divisional Level Committee, district level committee, state level monitoring committee; Procedure or filing, determination and verification of claims by the Gram Sabha; etc.
