Abstract
These Rules are made in exercise of the powers conferred by sections 3, 6 and 25 of the Environment (Protection) Act, 1986 (29 of 1986) and in suppression of the Solid Waste Management Rules, 2016. These Rules shall apply to all urban and rural local bodies, including all entities within their jurisdictions whether being controlled and managed by the government, private sector, or in Public Private Partnership. Chapter II contains provisions for environmentally sound management of solid waste. It lays down the duties of waste generators, operators of solid waste processing facilities, local bodies involved in collection, segregation and transportation of solid waste, industrial units and waste to energy plants. The criteria is set for waste to energy conversion process. Chapter III provides for rules relating to sanitary landfills. Chapter IV lays down the implementation framework including a centralised online portal for registrations and filing annual returns, compensation mechanism, and governance structure at central and state level. Chapter V contains duties of various ministries and government departments, local bodies and pollution control boards.
