Abstract
This Act provides for establishment of Jal Nigam and Jal Sansthans for the development and regulation of water supply and sewerage services in the state of Uttar Pradesh. It consists of 13 chapters: I. Preliminary; II. Establishment, Conduct of Business, Functions and Powers of the Nigam; III. Establishment, Conduct of Business, Functions and Powers of the Jal Sansthans; IV. Vesting of Properties, Assets, Liabilities and Obligations and Transfers of Employees; V. Property, Contract, Finance, Accounts and Audits; VI. Taxes, Fees and Charges; VII. Water Supply; VIII. Sewerage; IX. Penalties And Procedure; X. External Control; XI. Miscellaneous; XII. Rules, Regulations And Bye-Laws; and XIII. Transitory Provision And Repeal.
Chapter I contains the short title, extent, commencement and definitions. Chapter II provides for the establishment of a corporation by the name of Uttar Pradesh Jal Nigam (Jal Nigam), its constitution, functions and powers. It lays down the provisions relating to terms of the chairman and other members, their disqualification, appointment of employees and delegation of powers etc. The functions of Jal Nigam include preparation, execution, promotion and financing of schemes, preparing state plans and rendering all necessary services with regard to water supply and sewerage. The Jal Nigam shall review and advise on the tariff, taxes and charges of water supply. Chapter III provides for constitution of a local authority known as Jal Sansthan for the improvement of water supply and sewerage services in any area as the state government considers necessary. It may also notify that, in rural areas where no Jal Sansthans are established, the Jal Nigam shall be deemed to be the Jal Sansthan for such area and exercise powers and functions accordingly. Chapter IV vests and transfers the property and assets of state department unto Jal Nigam and Jal Sansthans and also provides for transfer of the employees. Chapter V makes provisions in respect of execution of contracts, funds, grants and loans, accounting and audit and other related matters of the Jal Nigam and Santhans.
Chapter VI provides for levying of water tax and sewerage tax, method for calculating such taxes, fees and recovery of taxes. Chapter VII defines supply of water for domestic purposes and prohibits use for non-domestic purposes as well as wastage of water. Chapter VIII recognises the right of an owner or occupier of any premises to empty sewage of the premises into a sewer subject to obtaining written permission and payment of fees. It empowers the Jal Nigam and Sansthan to disinfect any tank, pool or well to check the spread of any dangerous disease. Chapter IX provides for penalties for offences committed under the Act. Chapter X states that the Nigam shall be guided by direction on questions of policy as given by the state government. It also requires the Nigam to furnish annual reports to the government. Chapter XII empowers the state government to makes rules and the Nigam and Jal Sansthans to make regulations and bye-laws.
