Abstract
This Act establishes the Uttarakhand Water Management and Regulatory Commission for sustainable management of water resources in the state of Uttarakhand. It consists of six chapters: I. Preliminary; II. Establishment of Commission; III. Powers, Functions and Duties of the Commission; IV. Arbitration, offences and penalties; V. Accounts, Audit and Report; and VI. Miscellaneous.
Chapter I contains short title, extent, commencement, applicability of the Act and definitions. Chapter II establishes the Uttarakhand Water Resources Management and Regulatory Commission (Commission) and provides for the appointment of chairperson and other member of Commission. Chapter III lays down the powers and functions of the Commission which includes approving Integrated State Water Plan/Basin Plan, determining the allocation and distribution of entitlements for various category of use of water, enforcement and monitoring, and such other functions as mentioned therein. Chapter IV provides for arbitration by the Commission for any dispute or difference arising between licensees and also lays down the offences and penalties. Chapter V lays down the procedure for grants to the Commission by the state government. It requires the Commission to maintain proper accounts and prepare annual reports in respect of its activities. Chapter VI empowers the state government to make rules and the Commission to make regulations for carrying out the purposes of the Act.

An Act to provide for the establishment of the Uttarakhand Water Management and Regulatory Commission Bill to Regulate water resources within the State, facilitate and ensure judicious, equitable and sustainable management, allocation and optimal utilization of water resources of environmentally, economically sustainable development of the State, fix the rates for water use for agriculture, industrial, drinking, power and other purposes and cess on land benefited by flood protection and drainage works from the owners of lands benefited through appropriate regulatory instruments according to State Water Policy and matters connected therewith or incidental thereto.
