Water (Prevention and Control of Pollution) (Manner of Holding Inquiry and Imposition of Penalty) Rules, 2024.

These Rules are framed in exercise of the powers conferred by clause (ma) of sub-section (2) of section 63 of the Water (Prevention and Control of Pollution) Act, 1974 (Act). It provides for the rules relating to filing complaint, holding inquiry, orders and penalties for offences committed under various sections of the Act. The procedure for filing of complaint by the Central Pollution Control Board, State Pollution Control Boards, Pollution Control Committees and Integrated Regional Offices of the Ministry of Environment, Forest and Climate Change, in their respective jurisdictions, is laid down. Further, the procedure for holding enquiry for adjudication under section 45A of the Act is laid down. The rules for transfer of complaint for lack of jurisdiction and extension of time for adjudication are also provided.
