Abstract
This West Bengal Panchayati Raj Act, 1973 is enacted to reorganize, strengthen and expand the activities of Panchayats in rural areas of West Bengal to enable them to act as units of self-government and to strive for socio-economic development and securing social justice for the people. The Act consists of 224 Sections divided into 6 Parts: I. Preliminary; II. Gram Panchayat; III. Panchayat Samiti; IV. Zilla Parishad; V. Audit; VI. Miscellaneous.
Part II provides for the establishment of Gram Panchayat. The State Government may, by notification, declare any mouza or part of a mouza or group of contiguous mouzas or parts thereof to be a Gram (Sec. 3). For every Gram the State Government shall constitute a Gram Panchayat bearing the name of the Gram (Sec. 4). A Gram Panchayat shall function as a unit of self-government for achieving the goal of human development including social and economic development and securing social justice for all. A Gram Panchayat shall also perform other functions as the State Government may assign to it in respect of (a) primary, social, technical, vocational, adult or non-formal education; (b) rural dispensaries, health centres and maternity and child welfare centres; {c) irrigation including minor irrigation, water management and watershed . development; (d) agriculture including agricultural extension and fuel and fodder; (e) improved breeding of cattle, medical treatment of cattle and prevention of cattle disease; (f) its acting as a channel through which Government assistance should reach the villages; (g) bringing waste land under cultivation through land improvement and soil conservation; (h) promotion of village plantations, social forestry and farm forestry; (i) arranging for cultivation of land lying fallow; (j) arranging for co-operative management of land and other resources of the village; (k) assisting in the implementation of land reform measure in its area; etc.
Part III and Part IV provide respectively for the constitution and establishment of Panchayat Samiti and Zilla Parishad, powers and duties, property and fund thereof, etc.
