Abstract
The purpose of this Act is to protect product names that refer to origin, territory or traditional uniqueness with the aim of promoting consumer protection, increasing the value of products and preventing unfair business practices. It applies to the names of food, wine and spirits and other products according to a regulation of the Minister that refer to origin, territory or traditional specialty.
The Act contains the following Chapters: I. Scope and definitions; II. Origin reference, geographical reference and traditional specialties; III. Product name registration; IV. Branding; V. Protection of the names of foreign products; VI. Protection of a geographical reference for wine and spirits; VII. Surveillance; VIII. Penalties, penalties, etc.; IX. Various provisions.
The rules of the Act describe the conditions for the protection of a product name referring to origin, defined territory, or to traditional specialties; the protection granted to registered product names; procedural aspects of registration; use of registered product names; international agreements; geographical references for wine and spirits; supervision; liability, etc.
