Abstract
The purpose of this Act is to protect the sea and the country's shores from pollution and activities that could endanger human health, damage the sea's living resources and disturb its ecosystem, pollute the environment or hinder the lawful use of the sea and beaches. If a pollution accident occurs, the environment shall be restored.
The Act contains the following Chapters: I. Objectives, scope and definitions; II.Board and appointment; III. Implementation of general provisions of the Act; IV. Acute pollution; V. Coercive measures and penalties; VI. Various provisions. Annex I lists the activities that may cause acute pollution of the sea or coasts due to the nature of the activity and / or its proximity to the sea and the factors to be considered in assessing the potential risk of operations to the marine and coastal environment. Annex II contains a list of oils and other substances that can be banned or restricted to the sea.
The Act authorises the Executive to set general provisions in different subjects falling within the Act, including provisions on limitation of the amount of oil in sewage water that may be led to the sea; equipment for ships, platforms, other offshore and onshore structures for the prevention and control of marine and coastal pollution caused by oil; waste oil collection and disposal, including the reception of waste oils from ships in ports; discharge of sewage into the sea from ships, platforms and other structures at sea; reception and treatment of waste from ships; how submarine cables, subsea pipelines and any kind of structures on the seabed are to be laid; operating license for business operations covered by this Act; etc.
The Act further contains rules on the responsibility of individuals and legal entities; the prohibition of discharges into the sea; the laying of materials and laying of submarine cables and subsea pipelines; disposal of waste from ships; waste tax; management of acute pollution; etc.
