Act No. 85 relating to toxic and hazardous substances.

This Act represents the legislative reference framework in matter of protection of public health and the environment against toxic and hazardous substances. It is divided into five Sections. Section I lays down the definitions of toxic substances and hazardous substances, so as to define the scope of this Act. Toxic and hazardous substances shall not be covered by these provisions if they are used in compliance with the laws referred to in article 3. Article 2 sets up a Committee on Toxic Substances.
Sections II and III lay down provisions applicable to toxic and hazardous substances respectively. The substances may be produced only upon permission issued by the Minister. They shall be sold and delivered in strong and well closed containers (arts. 8 and 10). Section IV lays down joint provisions, to be applied both to toxic and hazardous substances. Particular provisions are established as regards their use in agriculture and horticulture (art. 14). Toxic and hazardous substances may not be introduced into or mixed with foodstuffs or fodder unless upon special authorization under the present Act, the Act respecting the Control of Foodstuff and other Consumer Goods and Necessities. Article 23 sets out penalties.
