Decree concerning investigating activities for the granting of the authorizations provided for by article 11 of Act of 10 May 1976, No. 319, and subsequent amendments, in matter of dumping in marine waters or adjacent areas, of materials deriving from the dredging of sea and brackish basins beds or of coastal emerged grounds, and also from any other handling of silts in the marine environment.

Abstract
This Decree is divided into 2 articles and 3 Annexes. It establishes the procedures for the issue of the authorization to discharging silts deriving from dredging operations in marine waters and adjacent areas, such as shores, brackish ponds and coastal zones. Paragraph 2 of Annex A prohibits the dumping in the sea of dredging materials that may be classified as toxic or noxious waste or that could create a hazard to the marine environment and the marine living resources. The authorization is issued by the Ministry of the Environment upon investigation by the competent authorities and is aimed especially at the chemical, physical and microbiological evaluation of such materials. Annex A deals further with the application modalities, the investigating activities, the issue, refusal to issue, withdrawal of the authorization, inspections, protected areas in which the dumping is forbidden. Annexes B/1 and B/2 concern modalities and technical requirements of the reports to be submitted in order to obtain the authorization.
