Abstract
The Decree Law is organised in 9 articles and contains provisions for fighting forest fires and other urgent civil protection measures. Article 1 provides for the adoption of urgent measures to strengthen coordination, technological updating and increase operational capacity in forecasting, prevention and active fight against forest fires by Civil Protection. A "National Coordination Plan" is also required to be adopted by 10 October 2021. Art. 2 concerns urgent measures to strengthen the operational capacity of State agencies in the prevention and active fight against forest fires and Art. 3 lays down provisions concerning the land register. Art. 4 deals with measures to strengthen forest fire forecasting and prevention activities and interventions are inspired by the principle of enhancement and protection of the forest heritage. Art. 5 concerns measures for strengthening active fighting and sanctioning devices and introduces changes to the framework law on forest accidents and Art. 6, on the other hand, makes several changes to the Criminal Code. In particular, three paragraphs have been added to art. 423 bis c.p. (Forest fire), two new articles have been introduced: 423 ter c.p. (Ancillary penalties) and 423 quater of the Penal Code (Confiscation), in addition, art. 32 quater of the Criminal Code (Cases in which the conviction results in the inability to contract with the public administration).
