Abstract
The Law-Decree is organised in III Titles. Title I concerns fair trade and competition and contains several provisions that concern liberalization of economic activities and reduction of administrative red tape for businesses. It also lays down rules on consumer protection, energy sector, bank, insurance and transport sector. Title II, on Infrastructure, contains provisions that promote development and regulate building infrastructure, ports, transport, and agricultural infrastructure. Title III contains miscellaneous provisions.
Under Title II, Heading III, Articles 62 lays down provisions concerning the sale of agricultural and agro-food products (the article does not apply to the end consumer selling); it indicates the form, payment method, excludes application of certain clauses to the contract and enunciates the principles to be respected by the parties. A particular focus is given to contracts concerning perishable products.
Art 66 rules that on annual basis the Minister must launch a review process of the current state-owned lands and identify those agricultural public lands not otherwise usable by the administration and put them on sale or for rent. In the sale and renting selection process right of first refusal is given to young rural entrepreneurs.
Art. 67 modifies Art. 5 of the Legislative Decree No. 226/2001 that lays down guidelines and provisions aimed at modernizing the fishery and aquaculture sector. Under Art. 67 the Minister can stipulate agreements with national trade associations to a) promote the use of environmental sustainable technologies for production activities; b) promote actions aimed at protect the marine and coastal environment; c) protect and promote traditional local food, and organic and high quality local products; d) set up traceability system within the seafood industry supply chain; e) simplify access to credit; f) reduce administrative red tape in a series of procedures; g) provide technical assistance to businesses within the Common Fishery Policy actions.
