Abstract
DPCM 22 March 2020 Art. 1 a) introduces a nation wide general ban of all industrial and commercial production activities exception made for the activities listed in Annex 1 (this list includes: agriculture and production of animal products, fishery and aquaculture, food industry, production of machinery for food and agriculture, utilities, wholesale of raw materials for agricultural and live animals; wholesale of machinery, equipment, machines, accessories, agricultural supplies and agricultural tools including tractors). This list can be modified by decree of the Minister of Economic Development, after hearing the Minister of Economy and Finance. Art. 1, 1) continues confirming that the provisions in the DPCM 11 March 2020 for professional activities and commercial activities are still valid.
Letter d) grants the activities that are functional to ensure the continuity of the supply chains of the activities referred to in Annex 1, subject to communication to the Prefect that may suspend the aforementioned activities if he believes that they are not functional.
Letter e) confirms that as well the public utility services and the essential services (L 146/1990) are always permitted.
Under letter f) it is granted the production, transport, marketing and delivery of drugs, healthcare technology and medical-surgical devices as well as agricultural and food products is always allowed. Any activity that is functional to deal with the emergency is also permitted.
Under g) it is confirmed that continuous production cycle plant activities are permitted, subject to communication to the Prefect, and from which interruption could causes serious damage to the plant itself or a danger of accidents.
Art. 1, 3) Companies whose activities are not suspended must respect the provisions contained in the Protocol of March 14, 2020 Regulating measures to combat and contain the spread of the covid-19 virus in the workplace.
Time in force and abrogations: the provisions of this decree are effective until April 3, 2020. They apply cumulatively with the measures of DPCM 11 March 2020 as well as Minister of Health Order of 20 March 2020 (extended up to April 3rd 2020).
