Abstract
DPCM 26 April 2020 substitutes and amends the DPCM 10 April 2020. Under Art. 1 confirms a series of previous urgent containment measures, valid across the entire national territory. For commercial activities that are not suspended, it is required to ensure an interpersonal distance of 1 meter, guarantee a strict regulation of premises access and ensure that persons do not stay inside the premises longer than the time necessary to complete purchases. Regardless of the type of activity carried out, markets are closed, with the exception of stands aimed only at the sale of food. In regard to food retail sector activities the DPCM 26 April contains the following amendments to the previous measures: cafeterias and contracted catering services that guarantee an interpersonal distance of at least 1 meter are allowed. Foodservice activities (cafes, pubs, restaurants, gelaterie, and pastry shops) are solely allowed to continue through takeaway and delivery services that respect hygiene regulations both in terms of packaging and delivery, and the interpersonal distance of 1 metre. Products must not be consumed inside the establishment and it is not allowed to remain nearby the premises.
Art. 2 states that all industrial and commercial production activities are suspended, with the exception of those listed in Annex 3 (albeit modified, the Annex in regard to the agricultural, fisheries and food production sectors includes same activities as per the DPCM 10 April 2020). Businesses which are not suspended must comply with prescribed protocols for containment and prevention measures in the workplace. Public utility and essential services are always allowed, as well as agricultural and food production activities. Businesses which will resume activity from 4 May 2020 may undertake preparatory activities from 27 April 2020. In order to allow productive activities to safely take place, regions must monitor the evolution of the epidemiological situation daily and accordingly, the capacity of the regional health care system. Monitoring data must be communicated daily to the Ministry of Health, the Istituto Superiore di Sanità, and the Scientific Committee of the Civil Protection Department. In the even that increased health risks emerge from the monitoring, the president of the concerned region must present in a timely manner the necessary and urgent restrictive measures for productive activities specifically affected by the worsening situation.
Annex 5 lists specific hygiene and sanitation measures to be adopted in commercial activities.
Annex 6 contains integrations to the "Protocol on shared regulation for contrast and containment of dissemination of COVID-19 virus in the workplace" of 14 March 2020 (the Protocol) regarding professional activities and production activities (adopted on April 24th). It includes operational statements aimed at increasing efficiency of containment measures in non-sanitary work environments, these include provisions for entering and exiting the premises, cafeteria management among others.
Annex 8 contains the "Shared regulatory protocol for the containment of the diffusion of COVID-19 in the transport and logistics sector", an integration to the 14th March Protocol. This outlines hygiene and sanitation measures to be adopted by personnel in the transport, delivery and manage of cargo via ship, rail, plane and truck.
