Abstract
On the basis of Act No. 388 of 23 december 2000, the present Decree sets up the submerged Park of Gaiola. The Park shall comprise the maritime waters adjacent to the promontory of Posillipo and the islands of Gaiola, which are delimited by a line joinig the latitude and longitude points referred to in article 2. The related coastal territories falling within the maritime domain shall be comprised too. The following aims shall be pursued: (a) environmental protection of the area concerned; (b) promotion of environmental resources; (c) promotion of the knowledge of ecological and biological aspects of marine and coastal environments; (d) performance of educational programmes relating to marine biology; (e) promotion of scientific research and studies in the field of ecology and marine biology. All activities that are likely to compromise the preservation of the environmental features of the Park or that might interfere with the attainment of the objectives aforementioned (i.e. hunting, gathering of plants, introduction of non autochthonous animal and plant species) shall be prohibited (art. 4). The Park is divided into two different Zones. Paragraphs (2), (3) and (4) of article 4 provide for the demarcation of Zone A (Integral Reserve) and determine the activities which shall be, on the one hand, forbidden (such as professional and sport fishing, bathing) and, on the other hand, the acitivities which shall be permitted. Paragraphs (5), (6) and (7) apply to Zone B (General Reserve). In case of infrigement, the penalties laid down in article 30 of Act No. 394 of 1991 shall be applied.
