Abstract
This Law regulates organic-production methods and practices for the agricultural, agri-food and aquaculture sectors. The Law disciplines: a) the system of national and local authorities and competent bodies; b) the organic districts, production and market organization, including producers associations and others; c) actions for the protection, promotion and development of agricultural, agri-food and aquaculture production with organic method, including administrative simplification, financial initiatives, information and institutional communication campaigns; d) the use of a national trademark.
Heading II, Arts. 3 and 4 identify in the Ministry of agricultural, food and forestry, policies and Regions respectively as the National and Local competent Authorities. Art 5. establishes the Italian Organic Trademark. Heading V lays down the discipline to enable the Minister to draft a full range of planning instruments aimed at promoting the organic method production, incentive research and financing, these include National action plan for organic production and organic products, National Plan for organic seeds, Fund for organic production development, promotion of contracts and producers associations agreements and trainings.
Heading VI contains provisions on the organization of production and the market. It disciplines organic districts and integrates the definition made under Art. 13 of Legislative Decree 18 May 2001, No. 228. The Heading specifies that organic districts are established in order to: a) promote conversion to organic production and encourage the sustainable use of natural and local resources in agricultural production processes, as well as guaranteeing the protection of ecosystems, supporting design and innovation at the service of a circular economy; b) stimulate and favor the territorial approach to conversion and the maintenance of organic production, even outside the administrative boundaries; c) simplify, for organic producers operating in the district, the application of organic certification standards; d) favor the development, enhancement and promotion of processes of preparation, transformation and marketing organic products; e) promote and support related activities such as direct sale of organic products, fishing tourism, rural tourism, actions aimed at the protection, enhancement and conservation of agricultural and natural biodiversity, as well as reduction the use of plastic; f) promote greater dissemination and enhancement at the level of local organic products; g) promote and implement participatory research projects with the companies and the dissemination of innovative practices. Furthermore, the Heading regulates intersectoral collaboration and associations, framework agreements, among others.
Art 18 concerns the trade of organic seeds. Art 19, to improve control and harmonization of the organic production discipline and enhance consumer protection, enables the Minister to adopt by Decree a series of measures that improve traceability, combat fraudulent practices and reduce conflict of interests, among others.
