Abstract
This decree establishes a framework for the planning of maritime space in order to promote the sustainable growth of maritime economies, the sustainable development of marine areas and the sustainable use of marine resources, ensuring the protection of the marine and coastal environments through the application of the ecosystem approach, taking into account land-sea interactions and the strengthening of cross-border cooperation.
This decree applies to the marine waters of the region of the Mediterranean Sea. It does not apply to coastal areas waters that fall within the urban and rural plans nor to activities whose goal is the defense or national security, nor to the urban and rural planning.
The maritime spatial planning intends to contribute to the sustainable development of the energy sectors of the sea, maritime transport, fishing and aquaculture, for the conservation, protection and improvement of the environment, including impact resilience of climate change, promoting and guaranteeing the coexistence of relevant activities and relevant uses.
It is elaborated and implemented by applying the ecosystem approach and taking into account: a) the peculiarities of the marine regions, the relevant activities and relevant current and future uses and the related effects on the environment, as well as natural resources; b) the economic, social and environmental aspects as well as aspects relating to the safety of civil and productive uses of the sea; c) the land-sea interactions, including through the use of elements contained in other planning processes, such as integrated coastal zone management or equivalent formal or informal practices.
Maritime spatial planning is implemented through the development of management plans, which identify the spatial and temporal distribution of the relevant activities and relevant uses of marine waters.
The Decree identifies the authorities which are competent to define the planning process uses and activities relating to the maritime space, to elaborate the plans of maritime space management. The Ministry of Infrastructure and Transport is the ultimate competent Authority pursuant to this decree.
