Abstract
This Decree identifies maritime security measures that have the objective of improving the security in ports and of ensuring that the measures adopted in application of Regulation (EC) No. 725/2004 are reinforced. The Decree applies to all ports as defined by article 2 of the Decree. It doesn't apply to military port installations.
The Ministry of Transport - General Command of the Port Authority Corps (the Administration) is in charge of coordinating the adoption of technical measures aimed at improving the security of ports, as well as to monitor their implementation.
The Decree also provides that the Port Authority, with regard to the ports under its competence, or the Maritime Authority with regard to the other ports, prepare a security assessment for each port, taking into account the specific characteristics of the different zones and their adjacent areas, if they have a impact on port security.
The Decree futher sets provisions relating to the Port security authority, which is responsible for security matters concerning all ports under its jurisdiction; relating to the Port security plan, which is elaborated by the Port Security Authority. Also a national ports security contact point is established, which communicates to the European Commission the list of ports subject to the present Decree.
The Administration adopts security levels in use for each port or part of the port, in compliance with the procedures established for determining the levels referred to in Regulation (EC) no. 725/200.
