Legislative Decree No. 102/2025 introduces supplementary and corrective provisions to Legislative Decree No. 18/2023, which transposed Directive (EU) 2020/2184 concerning the quality of water intended for human consumption. The Decree refines and expands the regulatory framework governing water safety, quality standards, and monitoring obligations, with a view to ensuring full alignment with the European directive and addressing implementation gaps identified in the earlier legislative instrument. Among its principal innovations, the decree strengthens the risk-based approach to water management, mandating comprehensive Water Safety Plans (WSPs) for both public supply systems and internal distribution networks, including those within sensitive facilities such as healthcare institutions and educational establishments. The Decree also revises the parametric values for several key contaminants, including lead, turbidity, PFAS (per- and polyfluoroalkyl substances), and Legionella, introducing more stringent thresholds and expanding the scope of mandatory monitoring. In particular, it incorporates trifluoroacetic acid (TFA) into the list of regulated PFAS compounds and imposes specific obligations on operators of internal systems to monitor Legionella levels. To ensure the safety and suitability of materials used in water treatment and distribution, the decree establishes the ReMaF (Registro dei Materiali e dei Filtri), a national registry for the authorization of reagents, filters, and devices. This registry is intended to guarantee that such materials do not compromise water quality or pose risks to public health. The scope of the legislation is further broadened to include previously unregulated entities such as water kiosks, domestic treatment devices, and water houses, which are now subject to compliance with quality standards and documentation requirements. The definition of “operator” is also expanded to encompass private entities that utilize self-sourced water for human consumption. In terms of data governance, the decree introduces the AnTeA platform, a digital infrastructure designed to facilitate interoperability and data exchange among water operators, competent authorities, and consumers. It sets clear deadlines for the transmission of relevant data, thereby enhancing transparency and regulatory oversight. Finally, the decree provides for a system of administrative sanctions, with fines.
