Legislative Decree No. 108 implementing Directive No. 89/109/EEC on materials and tools destined to come into contact with food.

The Decree amends the following articles of Presidential Decree of 23 August 1982, No. 777: (a) article 2, on the penalties to be inflicted in case of contravention; (b) article 3, on the enactment of Decrees by the Ministry of Health for the approval of materials destined to come into contact with food, of substances to be used for their production and, if deemed necessary, of purity standards and safety tests; (c) article 4, on the information to be provided in the labels regarding the characteristics of such materials. Further amendments concern the addition of article 5-bis, on the control of the compliance with the provisions of the present Decree, and article 5-ter, on the use of substances not included in the lists approved by the European Community, but authorized by decree of the Ministry of Health, upon verification of their safety.
