Abstract
The Legislative Decree is organised in VI Parts and has the scope to harmonise and reorganize the regulations concerning the consumption processes, in order to ensure a high level of consumer and user protection. Part I, general dispositions, lists specific consumer rights, these are: a) health protection; b) product and services safety and quality; c) right of information and honest advertising; c-bis) exercise of commercial practices according to principles of good faith, fairness and loyalty; d) consumer education; e) correctness, transparency and fairness in contractual relations; f) promotion and development of free associations, voluntary and democratic among consumers and users; g) quality and efficiency in public services.
Part II is on consumer education, product information, commercial activities, and advertisement. Part III concerns contractual relationship between seller and buyer, unfair terms in consumer contracts, rules applicable to commercial activities, types of contracts. Part IV lays down provisions on product quality and safety, defect product liability, legal guarantee of conformity and commercial guarantees for consumer goods. Part V is on consumer associations and access to justice and Part VI I s final provisions.
