Legislative Decree No. 535 implementing Directive No. 91/682/EEC on the trade of ornamental plants propagating material.

The present Decree regulates the trade within the Community of ornamental plant propagating material listed in the Annex. The placing on the market of said material by the suppliers is subject to the issuance of an authorization by the Region or the Autonomous Province. Further provisions concern the obligations of the suppliers, with respect to the quality of the material, to the cultivation methods and to the keeping of the relevant registers. Article 10 concerns the creation of the National Register of ornamental plants, and sets out the procedure to be followed by the suppliers wishing to apply for the registration of a plant variety. The implementation of the provisions of the present Decree is entrusted to the Advisory Committee for ornamental plants and ornamental plant propagating material, established by Decree of the Ministry of Agriculture and Forestry. Article 14 establishes the penalties to be inflicted in case of contravention.
