Abstract
Pursuant to Directives 75/439/EEC and 87/101/EEC, this Legislative Decree has been enacted to regulate the keeping, the collection and the disposal of waste oils with a view to preventing harmful effects on human health and the environment. The operations above-mentioned are subject to the prior issuance of an authorization, as prescribed by article 5. The authority which has granted the authorization shall be entitled to carry out inspections and sampling operations to verify the compliance with the conditions hereby established. The disposal of waste oils, which are fully defined under article 1 (1), shall be carried out without causing any damage to the environment and human health. On such basis, article 3 sets forth particular prohibitions and duties. The following are forbidden: (a) any discharge of waste oils into inland surface water, ground water, territorial sea water and drainage systems; (b) any deposit or discharge of waste oils harmful to the soil and any uncontrolled discharge of residues resulting from the processing of waste oils; (c) any processing of waste oils causing air pollution which exceeds the level prescribed by existing provisions. In the processing of waste oils priority shall be given to regeneration (art. 3, par. 3). The Ministries referred to in article 4 shall provide for the effective implementation of these provisions. Article 11 regards the organization and membership of the Consortium for waste oils. Article 14 lays down penalties. The Annex attached establishes emission limit values applicable to certain substances resulting from combustion of waste oils.
