Abstract
This Ministerial Decree makes provision in matter of veterinary drugs marketing, related authorization and preservation conditions, in compliance with articles 31 and 32 of Legislative Decree No. 119 of 27 January 1992. Article 2 lays down detailed rules concerning the requirements to be met by wholesalers for obtaining the authorization to place veterinary drugs on the market. Such requirements include the registration of the wholesaler in the Register of Enterprises kept by the competent Chamber of Commerce. Once the authorization has been issued by the competent Region (or Autonomous Province), it shall be transmitted to the Ministry of Health. Authorized wholesalers must comply with the duties set out by article 4. Article 6, on the other hand, lists out the conditions under which retail sellers may be granted the above-mentioned authorization. Articles 12, 13, 16, 17 and 18 lay down preservation requirements. Without any prejudice to the competences belonging to the Ministry of Health (as per article 18 of Legislative Decree No. 119 of 1992), inspections shall be carried out by the veterinary services under the Local Health Authorities. Furthermore, the Regions as well as the Autonomous Provinces shall transmit annually to the Ministry of Health a report concerning the results of such inspections. Article 21 refers to the suspension and withdrawal of the authorization.
