Abstract
Pursuant to Act No. 394 of 1991, this Regional Act lays down rules governing the setting up and the management of protected areas in the Calabria Region for the purposes of ensuring the rational and sustainable exploitation of natural resources, the respect of the ecological balance and the preservation of animal and plant species and related genetic resources. The Provinces, the Mountain Communities and the Communes shall participate in the establishment and management procedures. The regional system of protected areas is composed of the following categories: (a) regional nature parks; (b) regional nature reserves; (c) regional natural monuments; (d) protected landscapes; (e) monumental urban landscapes; (f) Community sites; (g) public urban parks and botanical gardens. Those categories shall be connected through the implementation of a special information system. A Technical and Scientific Committee for Protected Areas is set up to support the Regional Council (art. 5). Article 6 describes the procedure to be followed to set up new protected areas. A protected area is established by a Regional Act indicating the objectives to be achieved, the perimeter of the area, the Managing Entity, safeguarding measures, criteria for the elaboration of the relevant plans as well as the classification of the protected area (art. 11). Articles 41 to 44 set out penalties and implement the polluter pays principle.
