Abstract
This Regional Act aims at promoting and protecting horticulture, floriculture, fruit production and ornamental plants production in the Veneto Region. It also encourages the professional qualification of operators concerned and boosts the creation of green areas. The Act consists of thirteen articles. Article 2 deals with the authorization which is compulsory for producing and placing on the market plants, parts of plants, seeds and bulbs and for creating new green areas as well. The authorization shall be granted by the Regional Phytosanitary Service only if the professional requirements listed out in article 3 are met by the applicant. The application must be accompanied by a technical and economic report describing, among others, the equipment of the enterprise, the origin of plants used, technical and structural features of the enterprise (art. 3, par. 3 and 4). Without any prejudice to the obligations laid down in Legislative Decree No. 536 of 1992, article 4 of this Act sets out further obligations of the holder of the mentioned authorization, including: (a) keeping of certain documents to be produced when inspections are carried out; (b) performance of checks on phytosanitary conditions of cultures; (c) enforcement of any provision established by the Regional Phytosanitary Service. Authorized operators shall be registered by the Regional Phytosanitary Service , in compliance with article 6 and without any prejudice to the register provided for in Legislative Decree No. 536 of 1992. Article 7 deals with inspections during all stages of production, conservation and marketing. Article 8 lays down penalties, including the withdrawal of the authorization. Article 9 concerns greenhouses construction.
