Regional Act No. 42 making provision on nature parks and reserves

Type of law

The present Regional Act provides the principles and rules governing the setting up of nature parks and reserves within the Friuli-Venezia Giulia Region, bearing in mind the legislative framework laid down in Act No. 394 of 1991 on protected areas, as well as the purposes of protecting, preserving and restoring, where necessary, the environment and landscape. The sites of a Community importance identified under Directive 92/43/EEC shall be taken into account by the regional authority in the delimitation of reserves. Article 8 provides for the establishment of the Technical and Scientific Committee for Parks and Reserves, a consultative body which shall give mandatory or voluntary opinions, as the case may be. Regional parks and reserves are to be set up by Regional Act (art. 9). A conservation and development plan as well as a regulation shall be drawn up for each park or reserve (arts. 11-18). Article 36 prohibits hunting within any nature park or reserve. Hunting may be authorized under certain circumstances and solely for the purpose of facing ecological imbalance. Articles 38 to 40 regard surveillance and penalties. Articles 41 to 55 provide for the creation of a number of nature reserves, nature parks and protected areas.
