Abstract
Regulations to implement the Water Resources Act, 1995. The 33 regulations are divided into 6 Parts: Preliminary; Licences to Abstract and Use Water; Protection of Undergroundwater; Miscellaneous Powers of Authority; General; Transitional Provisions. An application for a licence, required pursuant to section 19 of the Act, shall be in the form set out in Form A of the Schedule (reg. 3) and a licence granted by the Water Resources Authority (the Authority) under regulation 3 shall be in the form set out in Form B (reg. 5). Regulation 4 prescribes that the Authority, in considering an application for a licence, shall have regard to provisions of the Master Plan and various other requirements of water resources management. Other provisions of Part II deal with variation, suspension or revocation of licences granted under regulation 3. The application for consent of the Authority to sink, enlarge or otherwise alter a well shall be in the form as set out in Form C of the Schedule. The consent shall be in the form of Form D (reg. 18). Applications for a well-driller licence required under section 35 of the Act shall be in the form of Form E and the licence shall be in the form of Form F (reg. 19). Other provisions of Part III deal with renewal and revocation of such licences and powers of entry, inspection and taking of samples of the Authority. The remaining regulations provide, inter alia, for the registration of easements, information as to undergroundwater to be supplied by licensees and licences of right referred to in section 54(1) of the Act.
