Abstract
This Regulation consisting of 17 articles aims to regulate the operations of the workforce sector, preserve workers' rights without discrimination, and ensure their coverage under the social insurance per the Social Security Law in place. Article 3 establishes that (i) the agricultural work contract is considered for a fixed term if it is agreed between the worker and the agricultural employer to work for a specific period or season. Otherwise, the agricultural work contract is considered to be of unlimited duration; (ii) the agricultural worker may prove his rights by all legal methods of proof if the contract is not drawn up in writing. Article 4 establishes working hours, rest hours, extra hours in case of emergency. The agricultural worker is entitled to a weekly day off according to the nature of agricultural work (art.5). Agricultural work is prohibited under 16 years of age, while the age of 18 must be completed for agricultural work that is dangerous, exhausting, or harmful to health, and these jobs are determined by a decision issued by the Minister (art.6). Article 7 deals with annual leave. Article 8 provides for (i) the wage of an agricultural worker, that may not be less than the minimum wage specified in accordance with the law; (ii) payment of the wage and prohibition of deductions except in cases permitted by law; and (iii) duty of equal wages for agricultural workers for every work of equal value without any discrimination based on sex. As for article 9 the agricultural business owner is obligated and at his expense to provide suitable housing for agricultural workers and appropriate facilities in the event that the nature of the agricultural work requires that or the agricultural work contract includes this condition. An agricultural business owner who employs at least twenty agricultural workers is obligated to establish an internal system that indicates working hours, daily rest periods, holidays, vacations, work violations, penalties (including dismissal from work and its implementation). The internal system is subject to the approval of the Minister (art.10).
