Abstract
The purpose of this Act is to contribute to the proper use of atomic energy in power generation by taking necessary measures, etc. to ensure the planned and reliable implementation of final disposal of specified radioactive waste generated after reprocessing, etc. of spent fuel produced in the operation of nuclear power reactors.
The Act consists of the following Chapters: 1. General Provisions; 2. Basic Policy, etc.; 3. Selection of Preliminary Investigation Areas, etc.; 4. Implementation of Final Disposal, etc.; 5. Nuclear Power Environmental Improvement Organization; 6. Designated Corporations; 7. Miscellaneous Provisions; 8. Penal Provisions and Supplementary Provisions.
In this Act, "final disposal" means the final disposal of specific radioactive waste by safely and securely burying it in a geological layer at a depth of 300 meters or more underground as specified by Cabinet Order, taking the necessary measures to prevent specific radioactive waste and materials contaminated by it from scattering, flowing out, or seeping into the ground. The Act provides for the establishment of the Atomic Energy Environmental Management Organization (AEEMO) and its responsibilities in managing the disposal of radioactive waste generated from nuclear power plant operations. The AEEMO is tasked with conducting surveys to select suitable areas for the final disposal facility. This involves assessing the geological stability of the area, including potential risks from natural phenomena such as earthquakes and volcanic activity. The organization must also consult with relevant local authorities and stakeholders before finalizing the disposal site. The Act further makes provisions, for: obtaining approval from the Minister of Economy, Trade, and Industry for the final disposal plan; the role of the AEEMO in overseeing the proper management of radioactive waste, including the reprocessing of spent nuclear fuel and the disposal of specific radioactive waste; final disposal reserve fund; etc.
