Abstract
The main purposes of this Law are to establish an EEZ and to define the extent of the continental shelf, in accordance with the 1982 Law of the Sea Convention. With regard to the EEZ, the Law stipulates that an EEZ is established as a zone in which Japan exercises sovereign rights and other rights provided for in Part V of the Convention. This zone comprises the maritime area, its sea-bed and subsoil up to a line of 200 nautical miles (n.m.) from the baselines, excluding the territorial sea. Where that line lies beyond the median line with a neighbouring state, the outer limit of the zone shall be the median line, unless otherwise agreed with the state concerned. This Law, unlike the 1977 Law on Provisional Measures Relating to the Fishing Zone, does not exclude the East China Sea, a part of the Pacific Ocean adjacent thereto, the Yellow Sea and the western part of the Sea of Japan from these provisions.
The continental shelf is defined as (i) The area, excluding the territorial sea, extending up to the line of 200 n.m. from the baseline, except where that line lies beyond the median line with a neighbouring state, in which case up to the median line, or up to other line to be agreed upon with the neighbouring State and other lines connected with such line to be defined by Cabinet Order; and (ii) The area adjacent to the area defined in (i) above having the outer limit of 200 n.m. from the baseline, to be established by Cabinet Order in accordance with art. 76 of the Convention.
The Law makes consequential provisions for the exercise of Japanese jurisdiction in these areas; in fact, Japanese law shall apply in this area with respect to (a) the exploration, exploitation, conservation and management of natural resources, artificial islands, installations and structures, protection of the marine environment as well as marine scientific research in the EEZ or continental shelf; (b) the exploration and exploitation for economic purposes in the EEZ; (c) drilling into the continental shelf; (d) the exercise of the functions of Japanese civil servants relating to the above-mentioned matters in the EEZ and continental shelf.
Finally, the Law states that where the LOS Convention provides otherwise with regard to matters covered by it, the Convention's provisions shall apply.
