Abstract
These Regulations, implementing provisions of Climate Change Act, provide for: promoting Kenya’s participation in the framework for non-market approaches as set out in Article 6.8 of the Paris Agreement by aligning national processes with international requirements, and fostering voluntary co-operation between Parties in support of sustainable development and climate goals; enhancing linkages and creating synergies among stakeholders for identified opportunities for cooperation in non-market approaches; ensuring a framework for the implementation and co-ordination of non-market approaches that support the implementation of Nationally Determined Contribution; enhancing the participation of the public sector, private sector, civil society organisations and local communities in the implementation of Nationally Determined Contributions. The Regulations concern: design and implementation of programmes and projects and respect of human rights, fundamental freedoms, gender equity, and the rights of marginalised communities, children, youth and persons with disabilities; ensuring compliance with environmental requirements including strategic environmental assessments, environmental impact assessments and environmental audits; facilitating public participation; ensuring free, prior and informed consent obtained from communities where non-market approaches involve community land; priority non-market approaches interventions; dispute resolution. The attachment concerns the list of non-market approaches interventions, including: irrigation, water resources management, ecosystem and landscape restoration and conservation; conservation of public, private and community forests; promotion of agroforestry; early warning system; disaster risk reduction; promotion of eco-tourism; protection of marine ecosystem; social protection systems; sustainable fisheries and aquaculture management; technology and innovation for climate resilience; afforestation and reforestation programmes; sustainable waste management and circular economy; sustainable agricultural practices; public-private partnerships for renewable energy projects; sustainable biogas and biomass energy utilisation.
