Abstract
The Compliance and Enforcement Strategy is a Strategy made by Water Services Regulatory Board (WASREB). The aim is: 1) To ensure conformity to the Water Act 2002, rules and regulations made there under and guidelines issued by WASREB; 2) To prevent future violations as much as possible through voluntary effort; 3) To improve the standards of water service delivery in a sustainable manner in the whole country. The compliance and enforcement strategy of WASREB is grounded on the following methods: Education to foster learning, inducement and self regulation; Prevention through selective and targeted surveillance and a graduated warning approach; and Enforcement as a last resort using the traditional methods of coercion and deterrence.
Moreover WASREB will follow a series of approaches to achieve compliance, these are: 1) Information to make Water Service Boards (WSBs), Water Service Providers (WSPs) and other water operators and consumers to understand their responsibilities; 2) encouraging compliance through a number of activities such as Targeted campaigns promoting compliance in high risk areas of water safety and infrastructure safety as well as governance, disseminate best practice; 3) assistance to WSBs, WSPs and other water operators who are endeavoring to comply with regulation by offering training by own staff or partnering with the Kenya Water Institute and other third parties to offer training, by conducting or inviting advisory visits to the WSBs and WSPs, by holding workshops to disseminate technical information and obtain feedback on compliance; 4) monitoring through inspection, targeted surveillance, checklists, etc.; 5) warning by notifying, caution, orders, issue of cure notices to WSBs and WSPs that are not complying with their obligations; 5) the traditional full force of law when the other five approaches do not work includes issuing of fines under the license, etc.
