Abstract
This Act provides for implementing constitutional provisions focusing on the following topics: ensuring equitable and continuous access to clean water; promoting soil and water conservation; promoting water catchment conservation and protection; developing County water services public works; strengthening County water and sanitation public works; ensuring effective and efficient provision of water and sanitation services; promoting effective and efficient management of storm water in built up areas; enhancing suitable management of water resources; promoting inter-agency collaboration and public participation in water resource development and management. The Act concerns: establishment of the Department of Water Service, and definition of its functions; licensing of water service providers; agreements with water service providers; demarcation of riparian land and prohibited activities on the riparian land; obstruction of water resources and pollution of water sources; sanitation and sewerage services, including: control of effluent, execution of works for water protection; soil and water conservation measures; establishment of water resources users association; protection of storm water system; prevention of flood risk; storm water system on private land; targeted measures for control of pollution; general penalties.
