Abstract
These Regulations concern the conservation of biological diversity in Kenya and the control on access to genetic resources of Kenya.
“Access” means obtaining, possessing and using genetic resources for purposes of research, bio-prospecting, conservation, industrial application or commercial use. The Regulations shall not apply to genetic resources derived from plant breeders in accordance with the Seeds and Plant Varieties Act. The Regulations require an environmental impact assessment licence issued by the National Environment Management Authority for any activity: (a) having an adverse impact on any ecosystem; (b) leading to the introduction of exotic species; or (c) leading to the unsustainable use of natural resources. The Authority may impose a ban or restrictions on the access and use of threatened species and may regulate the activity of regeneration of stock of threatened species. The Authority shall establish an inventory of biological diversity of Kenya and monitor biological diversity. The measure of protection and restrictions regarding biological diversity shall apply to areas declared to be a protected natural environmental system for purposes of promoting and preserving biological diversity in accordance with the Environmental Management and Co-ordination Act. The Regulations further provide with respect to access permits and contain rules relative to benefit sharing imposed on holders of access permits.
