Abstract
These Regulations, made under section 92 of the Environmental Management and Co-ordination Act, provide for: ensuring protection of human health and environment from adverse effects of toxic and hazardous industrial chemicals and materials; reducing risks posed by chemicals and ensuring the sound management of chemicals; enhancing the free movement of chemical products; giving effect to the Stockholm Convention, the Rotterdam Convention, the Minamata Convention any other relevant provisions of international treaties, agreements and conventions on the management of chemicals. The Regulations apply to the manufacture, export, import, transport, distribution, storage, handling and disposal of toxic and hazardous industrial chemicals and materials as classified in the Schedules. Matters covered by these Regulations include: classification and registration of toxic and hazardous chemicals substances; laboratory analysis; labelling and packaging, appropriate labels for transport and storage of substances; compliance with the requirements of the national and globally harmonised system for labelling and classification of chemicals or materials; licence requirements for import and export of chemicals and hazardous substances; prior informed consent according to the provisions of the Rotterdam Convention; environmental impact assessment, environmental audit and chemical safety audit; minimisation of emissions during extractive processes; measures concerning distribution, storage, transportation and handling of substances; disposal of chemical and material waste; pollutant release and transfer register; offences and penalties.
