Abstract
These Regulations make provision for foreign fishing in the waters of Kenya. Fishing by foreign crafts in the territorial waters of Kenya is prohibited (reg. 18).
The 47 regulations are divided into 5 Parts: Preliminary (I); Licensing of foreign fishing vessels (II); Control of foreign fishing vessels in Kenya fishery waters (III); Marine fisheries research (IV); Miscellaneous provisions (V).
No foreign fishing vessel shall fish, attempt to fish or participate in fishing in Kenya fishery waters without a licence issued under regulation 6 (reg. 3). The diplomatic representative of any country in respect of which the Director has made an apportionment under section 12(2) of the Act may present a fishing plan (reg. 7). No licence shall be issued unless a local representative is appointed (reg. 8). Conditions of license are prescribed in regulation 10. Regulations of Part III provide, inter alia, for the following matters: trans-shipment of fish (20); notice of intention to enter zone (21); inspection before leaving the EEZ (23); markings (27); records (31); reporting (32); notification of completion of quota (33); navigational customs (36).
