Abstract
This Act, implementing constitutional provisions, provides for: ensuring equitable and continuous access to clean water; promoting soil and water conservation, water catchment conservation and protection; development and management of county water services public works; ensuring effective and efficient provision of water and sewerage services; effective and efficient management of storm water in built up area; enhancing sustainable management of water resources; promoting public education and equality among water uses and users; encouraging interagency collaboration and public participation in water resource development and management. This Act concerns the following topics: catchment area; water charges; water corporations; public works; water resources use, including: abstraction, discharge of materials; water works; water management, including: water planning and management, water supply, water quality management; water resources; water user associations.
Part II of the Act concerns establishment of the Garissa County Water and Sewerage Services Directorate, and definition of its functions. Part III concerns stakeholders participation in water and sewerage services and registration of water user associations. Part IV concerns water and sewerage services corporations, rural water services, water pollution prevention measures, management of land uses for the purposes of water conservation. Part V concerns water services, including: public-private partnerships; investment in water source prevention; water works development; water fees and charges; application for permits. Part VI concerns waterworks and water and sewerage services providers, including: borehole site identification; drilling of boreholes; water quality control; compulsory acquisition of land; protection of water resources; soil conservation measures. Further Parts concern: water harvesting; storm water management; sewerage services and water pollution control; enforcement measures; offences relating to conduct of employees of the corporation; financial provisions and special fund; miscellaneous provisions.
