Kenya Coast Guard Service Act, 2018 (No. 11 of 2018).

This Act makes provision for the establishment of the Kenya Coast Guard Service and defines its powers, functions, administration and internal organization. It also establishes the Council of the Kenya Coast Guard Service and the Technical Committee of the Kenya Coast Guard Service. The Act consists of 58 sections divided into 8 Parts.
The Kenya Coast Guard Service shall be deployed in the territorial waters (defined), among other things - enforce maritime security and safety, pollution control, and sanitation measures; to prosecute maritime offenders; for port and coastal security; and the protection of maritime resources including fisheries. It shall establish such operational units, support units and formations as the Council may determine. The Service shall have the power to do all things necessary for the performance of its functions under Service. this Act or any other written law. Specific powers of inspection and enforcement are defined. The Act also defines "innocent passage". Navigation in territorial waters of Kenya of a vessel polluting marine waters or involved in illegal fishing shall not be considered as innocent passage. The Council shall be responsible for the overall policy, control and supervision of the Service. The Technical Committee shall advise the Council on policy and financial matters relating to the Service and oversee the management and administration of the Service. The Act defines offences.
