Abstract
This Act, implementing Constitutional provisions, provides for: ensuring equitable and continuous access to clean water; promoting soil and water conservation; promoting water catchment conservation and protection; developing and managing County water services public works; ensuring effective and efficient provision of water and sanitation services; promoting effective and efficient management of storm water in built up areas; enhancing sustainable management of water resources; strengthening inter-agency collaboration and public participation in water resource development and management. The Act concerns: establishment of the Kilifi County Water and Sanitation Corporation, and definition of its duties and functions; liability of the members of the Board; establishment and functions of the Directorate; public-private partnership; water services, including supply of water, for agricultural, livestock and industrial use; service agreements; water tariffs; prohibited activities and issuance of permits; water and soil conservation measures, including: water catchment conservation, demarcation of riparian land, prohibited activities on riparian land; storm water management, including: land use practices, management plan; sanitation services and pollution control; compliance with effluent standards, interference with sewerage system; financial provisions and establishment of a County water trust fund; enforcement measures; water conflict resolution.
