Abstract
This Act, divided into nine Parts, provides for enhancing climate resilience through development, management, implementation, regulation and monitoring of adaptation and mitigation measures and actions in Kwale County, and particularly focuses on: introducing guiding principles for climate change measures and actions; establishing an appropriate coordination and implementation mechanism for climate change measures and actions; establishing a transparent financing mechanism for climate change measures and actions; strengthening climate resilience and capacities of communities in Kwale County for climate risks reduction and management; increasing transition towards low-emissions development and green economy anchored on resource-use efficient technologies; mainstreaming climate change considerations across sectors and into integrated planning and budgeting processes; facilitating public participation to enhance ownership and budget oversight and accountability for the county climate change response; developing a transparent and accountable monitoring, evaluation, and reporting platform; promoting collaboration and cooperation with public entities, private sector, civil society organisations and development partners; enhancing research and use of evidence, including indigenous knowledge in climate action planning; promoting adaptation and mitigation actions to curb effects of climate change by both private and public entities within the county; increasing education and awareness on climate change.
Concerning the guiding principles, this Act bases climate change actions and measures on the following: polluter pays principle; right to sustainable development; ecosystem approach; public participation and access to information; inter-governmental cooperation. The Act covers the following matters: establishment of committees; climate change response measures and actions, including: preparation of climate change action plan; duties of public and private entities relating to climate change; compliance measures; public participation measures and access to information, including: strategy for climate change education and public awareness, capacity building for effective public participation; establishment of the County Climate Change Fund; financial provisions and funding; offences and penalties.
