Abstract
These Regulations implement provisions of the Kwale County Quarrying Act, 2016 by providing guidelines on Common Minerals industry including—directions and forms; application processing procedures and forms; conditions for registration and licencing of common minerals harvesters and common mineral dealers; recommendations for general industry agreements/contracts between landowners, harvesters and dealers; harvesting, processing and marketing of common minerals; h rehabilitation of used quarries; statistical returns; such other matters as may be deemed necessary for effecting these Regulations.
Common mineral harvesting in the river bed shall be approved by the Technical Minerals Harvesting Committee. The committee may delegate its power of approval to the Common Minerals Resource Management Association where appropriate. Before Approval is issued, the committee shall take into consideration advice from Water Resources Authority, the National Environmental Management Authority or any other relevant agency. Harvesting of Common mineral shall not take place during heavy rains. The Regulations defines functions of the Committee and provides for protection of the environment from mining quarrying operations and impose requirements regarding Environmental Impact Assessment to be undertaken in accordance with the provisions of Environment Management Coordination Act, 2015. The factors to be considered in the establishment of Common Association. Mineral Resource Management Association shall include drainage network of the river designated sites along which Common mineral harvesting activities are carried out; inclusion of interest groups; and sustainability of the Association(s).
