Kwale County Water and Sanitation Act, no. 2 of 2020.

This Act, divided into thirteen parts, and implementing the constitutional provision ensuring the right of every person to have clean and safe water in adequate quantities, provides for: ensuring equitable and continuous access to clean and safe water; promoting soil and water conservation; ensuring water catchment conservation and protection; developing and managing county water services public works; ensuring effective and efficient provision of water and sanitation services; enhancing sustainable management of water resources; improving management of storm water in built up areas; promoting interagency collaboration and public participation in water resources development and management. The Act covers the following matters: powers and duties of County Executive Committee members; preparation of a County Water and Sanitation Services Strategy; establishment and functions of county water services provider, including entering into public-private partnership; water services, water supply, development of waterworks; tariffs for water and sanitation services; inspection, evaluation and monitoring of water service providers; offences, including: contamination of water and supply to domestic premises; raw water abstraction permits and access rights; development and operation of community water service providers in rural areas; measures regulating water vending kiosks; protection of water resources, storm water drainage, storm water management plan; catchment conservation; wastewater management and pollution control; sewerage tariffs; financial measures and establishment of a trust fund; water conflict resolution.
