The Machakos County Climate Change Act, no. 3 of 2021.

This Act, divided into nine Parts and consisting of 54 articles, implements provisions of section 19 (4) of the Climate Change Act no. 11 of 2016, and provides for the enhancement of climate resilience through development, management, implementation, regulation and monitoring of adaptation and mitigation measures and actions. The Act applies to each sector of the County economy, in order to: mainstream climate change responses into development planning; facilitate effective management of climate change impacts; support and facilitate community-based and community-initiated adaptation and mitigation activities; provide incentives for the private sector to contribute to achievement of low carbon climate resilient development; facilitate public participation in climate change response; ensure the protection of the right to a clean and healthy environment.
The Act covers the following matters: establishment and functions of various Committee: the Steering Committee, the Planning Committee, the Ward Planning Committee; measures and action to afford climate change: formulation and content of a Climate Change Action Plan; duties of public and private entities; monitoring and reporting on compliance; capacity building for effective public participation; establishment of a special fund for climate change and definition of its sources; general penalties.
