Merchant Shipping Act.

This Act makes provision for the registration and marking of ships and the licensing of Kenya ships and related matters, provides for the ownership of ships and related matters, prohibit the pollution of water and air by ships and regulate navigation by ships in Kenya waters. This Act does not apply to the regulation of inland water transport.
The Act applies to every description of vessel used in navigation not propelled by oars. The Act defines conditions for registration as a Kenya ship and specifies persons that are qualified to be an owner of a Kenya ship. The Minister may, by notice in the Gazette: (a) declare any port in Kenya to be a port of registry; and (b) appoint a registrar of ships, and deputy registrars at those ports of registry. The Act declares the discharge of oil by any ship into harbour waters or into the sea within 100 miles from the coast of Kenya and discharge of oil by a Kenya ship within 100 miles from the coast of any country to be an offence.
