Abstract
This Act, divided into eight parts and consisting of 55 sections, applies to: weather observers; meteorological service providers; private weather service providers; any meteorological training and research institution; any person, group of persons or organisation whose undertakings involve or include, generally, the use of meteorological information for commercial purposes. This Act provides for: ensuring the regulation, co-ordination, monitoring, management, and provision of meteorological services; ensuring fulfilment of the obligations of the Government under treaties and conventions on meteorology, in particular the Convention of World Meteorological Organization. The Act defines the following terms: aeronautical meteorological services; climate; climate change; environment; marine meteorology, as applied to activities in the coastal zone and ecosystems, fisheries and maritime transportation, in the oceans and inland water bodies; marine meteorological services; meteorological service provider; meteorological data and information; private good services; public good services. Part II of the Act concerns the establishment of the Kenya Meteorological Service Authority and the specification of its duties and functions: provision, regulation, co-ordination, monitoring, management and control of meteorological services; development and monitoring the implementation of government policies in respect of meteorology and related sciences; development of a national strategic plan for the Authority in alignment with international treaties, protocols, agreements, and conventions on meteorology; establishing and maintenance of surface, upper-air and marine meteorological observation networks and integrated information systems for the exchange of meteorological data and products and the processing, analysis, forecasting and archival of meteorological data; providing aeronautical meteorological services for the safety, regularity and efficiency of international air navigation; preparation and dissemination of weather forecasts, marine and tsunami early warning advisories, agricultural meteorological services to improve productive capacity; integrating traditional indigenous knowledge with modern science in weather forecasting; monitoring background environmental pollution and atmospheric chemical composition for greenhouse gases in the country for assessment of air quality and climate change detection and attribution; setting standards, developing curricula, providing training; conducting and co-ordinating research and development in meteorology and related environmental sciences. in meteorology
Part III of the Act concerns composition and management of the Board; management of the Authority; functions and powers of the Board; committees of the Board; appointment and duties of the Director General. Part IV focuses on the establishment of the Meteorology Training and Research Directorate. Part V concerns financial provisions, the creation of the Fund of the Authority and its investments. Part VI covers the establishment of observation stations; the protection of intellectual property rights on any meteorology data and advisory services generated by the Authority; limitation of liability. Part VII concerns general and specific offences and penalties. Part VIII concerns final and transitional provisions; court and other proceedings.
