Abstract
This Act provides for the constitution and registration of co-operative societies and promotion and development of the co-operative movement in Nyeri County. It defines the functions of the Executive Committee Member with respect to control and development of cooperative societies in the County. The Act also concerns the administration of societies and their dissolution, etc. The overriding objectives of this Act is to provide a comprehensive, harmonized, efficient and effective legal and regulatory framework for development and regulation of the co-operative sector in the County by — (a) enabling the formation, registration and operation of cooperatives; (b) promoting co-operative philosophy, principles, practices and objectives; (c) protecting the interests of co-operatives, their members and the public in the operations and activities of co-operatives; (d) ensuring directors and officials of co-operatives are accountable for their actions and decisions to the members of co-operatives.
A co-operative society which has as one of its objects the processing, marketing or selling of any agricultural produce, may enter into a contract with its members, either in its bylaws or by a separate document binding the members to process, market or sell all their agricultural produce, or such amounts or descriptions of the same as may be stated therein, to or through the society. "Agricultural produce" includes any produce or article produced or obtained by the work or industry of members of a co-operative society or marketed by a co-operative society, whether the produce be of agriculture, animal husbandry, forestry, fisheries and handicrafts. As or the settlement of disputes, the establishment, functions, proceedings and operation of the Co-operative Tribunal shall be governed by the national Co-operative Societies Act (Cap. 490). There is established a fund to be known as the Co-operative Development Fund.
