Abstract
These Regulations, made under section 101 of the Petroleum Act, apply to: importation of bulk liquid petroleum gas; exportation, wholesale and retail of liquid petroleum gas in bulk and in cylinders; construction and licensing of liquid petroleum gas installations; storage and refilling of liquid petroleum gas in cylinders; storage of bulk liquid petroleum gas at an import storage facility; storage of bulk liquid petroleum gas at consumer sites; storage of bulk liquid petroleum gas for use by schools and institutions of learning; transportation of liquid petroleum gas in bulk and in cylinders; sale of liquid petroleum gas through smart meters; sale of liquid petroleum gas through metered systems in a reticulated system; liquid petroleum gas for internal combustion engines; liquid petroleum gas installation works. The Regulations define the following relevant terms: approved persons to inspect pressure vessels; authorised distributor; autogas retrofit system; bulk liquid petroleum gas; bulk storage vessel; central tracking system; conversion centre; distressed brand owner; filling or refilling; installation pipework; Kenya Bureau of Standards; landlord; lease; licensing agent; liquefied petroleum gas business; liquid petroleum gas emergency; liquid petroleum gas installation licence; liquid petroleum gas recovery equipment; public use establishments; retailer; supplier; upstream emergency control; wholesaler.
The Regulations concern the following matters: licence application for undertaking liquefied petroleum gas businesses; requirements for liquid petroleum gas bulk storage; competence and training; liquid petroleum gas installation authorisation and licence; importation of bulk liquified petroleum gas; obligations of importer; obligations of a holder of a bulk liquid petroleum gas wholesale and export licence; retail of liquefied petroleum gas in cylinders; storage and display of liquid petroleum gas in cylinders; obligation of a liquid petroleum gas undertaking; construction permit for liquid petroleum gas for internal combustion engines; operations, obligations and penalties; liquid petroleum gas installer’s obligations; acquisition of new liquid petroleum gas cylinders; registration of brand and obligations of brand owner; liquid petroleum gas cylinders ownership; inspection; export of liquid petroleum gas cylinders and tracking system; public liability insurance; prohibition against unauthorised refilling; prohibited trade practices; damage of cylinders; acquisition of new bulk liquid petroleum gas storage vessels; methods and techniques for ensuring safe storage of liquid petroleum gas; emergency control; issuance of construction permit to supply liquid petroleum gas to consumer site or reticulated system; standards and safety; emergency response plan; service contracts; emergency instructions; rights and obligations of landlords; transport of liquid petroleum gas cylinders; prohibition against loading or discharging liquid petroleum gas into illegal facility; data collection; compliance and enforcement measures; reporting of accidents; general offences and penalties.
