Abstract
These Regulations, implementing sections 12(7) and 20 of the Standards Act, apply to: products for which the Cabinet Secretary has declared a standard specification pursuant to section 9(2) of the Act; products that do not have a specific mandatory standard but fall under the coverage of any general mandatory standard; establishments for which the Cabinet Secretary has declared mandatory standard specifications; and products that bear a standardisation mark and notified certification marks or marks notified under a mutual recognition agreement. The Regulations aim at monitoring products introduced in the market to ensure that the products conform to the applicable standards and reduce risk of harm to consumers. The Regulations concern the following matters: investigation and market surveillance operations; handling, transporting and storage of product; obligations of business operators; compliance to mandatory standards; reworking and recycling as conditions for marketing of the product; mandatory recall of the product in case of: adverse effect on health, safety and the environment; indication of a misrepresentation or adulteration of the product; nuisance to human health, animal health or environment; prohibition to sell products subjected to recall; liability for non-compliant products; general penalties.
