Abstract
This Act provides with respect to the public participation process in Tana River County. It establishes a legislative framework to give effect to selected provisions of the Constitution and of the County Governments Act, 2012. The main object and purpose of this Act is to provide a framework for participation by the public in affairs of the county through actively informing the form and content of legislation, policy and development plans formulated by the County Government. It also provides for public participation in service delivery by the County Government. The Act sets out the mechanisms, processes and procedures of public participation and establishes the Directorate of Public Participation, the Office of Public Participation and the Tana River County Budget and Economic Forum. There shall be established a Sub-county public forum at the sub-county level, ward public forums at ward level and village public forums at the village level. The Act also sets out the principles and objectives of public communication.
In carrying out their functions, the Directorate and the office shall ensure that the county government and County Assembly respectively and their agencies put in place affirmative action programmes to ensure equity for people with disabilities, women and other disadvantaged groups, minorities and marginalized groups (including having reasonable access to water, health services and infrastructure).
